Our company submitted a form 1 for mass terminations in April 2009 to the Government of Ontario but did not hand out notices to the employees until late september 2009.
Does a form 1 for mass terminations have a life span before a company must re-submit the form 1 to the Government of Ontario
The Lawyers and the Employment Standards people I've talked couldn't find out. It seems only reasonable the Form 1 would have a shelf life ( I'm hoping 3 months ). If a company filed a form 1 the day they start up a business would it be good forever ?.. The implications are huge - we did get the proper notice ie 120 days from the time the employer gave the employees the notice of termination. But if the Form 1 had expired , then the terminations would not be legal and we might get another 120 days termination pay.
I know it is a long shot but if anyone has any advice or experience in this kind of stituation I'd really appreciate any replies.
