Our HVAC unit has broken down, the AC side, every year for the past 5 years.  The drain pans, which are in the attic have now overflowed.  Water is dripping down from a light socket.  The ceiling is stained and so is the carpet.  The unit is still under an extended warranty so Sears refuses to replace it.  Each time it breaks down it takes weeks to get someone out to even look at it.  Then more time to wait for parts and installation.  We have carefully documented each occurance.  Do we have any legal recourse in this matter?

You mat want to contact the manufacturer and deal directly with them. 
If you want to pursue litigation then you could sue Sears and the manfuacturer for the defects in the HVAC unit.  However, be sure to check the warrant yinformation bevcause it may limit your legal options.
