Property flooding due to new development

My county, over the years, developed the rural area I live in. As an example, the community I live in once consisted of about 15 houses, spread over 8 wooded blocks with dirt roads. Each road had a shallow &lsquo;swale&rsquo; ditch to encourage drainage into the nearby main canals. <p>New regulations required new homes to be built on lots with added fill -- basically giving them this big house on a pyramid look -- for increased drainage. Over the years, the swale ditches were filled in by owners. Roads were paved and the 15 houses turned into something like 110 or more.</p> <p>The road in front of my home is now higher than my land. With no swale ditches, storm water cascades into my driveway and floods the lawn. Water draining from raised lots surrounding me flows into my yard. After decades with no serious flooding, I now periodically get water in my house.</p> <p>Down the road from me, a home owner filled in his swale ditch to make a parking spot. That blocked what little drainage there was to a main canal.</p> <p>It&rsquo;s only a matter of time before seasonal rains increase flooding into my home. All of this due to &lsquo;improving&rsquo; the area and increasing development.</p> <p>Can I sue the county over this? After all, my home was built according to regulations in 1958. We had no flooding until they &lsquo;improved&rsquo; the area and paved the road. Regulations requiring lots to be filled before construction to prevent flooding has simply pushed the waters down towards me.</p> <p>I&rsquo;d like it if they opened the swale ditches or even ran some drainage pipes from my yard, across the street into the main canal to drain the excess water.</p> <p>The only other option is to raise the house, something which will cost more than the place is worth.</p> <p>We just got hit with a tropical storm and the resulting rain flooded part of my house, something which would not have happened 20 years ago when there were fewer homes about.</p> <p>Some years back, so many homes with private water wells were draining the ground water that the City extended it&rsquo;s lines into the county and required everyone to hook up. We had begun to develop sink holes. That&rsquo;s how developed the area became.</p>
