Business email account being used to commit a class 1 misdemeanor

My brother in-law used my husbands email account to commit a class 1 misdemeanor, can we have him charged with anything?  His x-girlfriend is taking him to court for this.

This may be a violation of computer privacy laws in Virginia, if the brother-in-law accessed the email account without permision.
Contact your local police or Sheriff's department to report the incident, or you can contact the Commonwealth Attorney for your jurisdiciton.
