Gay Couples Legally Married Elsewhere Cannot Get Divorced in Texas

Wed Sep 1, 2010 In Texas, marriage is between a man and a woman - and so is a divorce. A Texas appellate court ruled that gay couples, even if they are legally married in another state, cannot get divorced in Texas. "A person does not and cannot seek a divorce without simultaneously asserting the existence and validity of a lawful marriage . . . " according to Justice Kerry P. Fitzgerald of the appellate court. The court went out to say that although divorces cannot happen, a court could declare the marriage void as a de facto method of divorce. |
