The employee attempted to poach a number of our staff to a new company which he works for but has since left that company and returned to his native country of the UK.

Yes you can serve a Notice of Civil Claim to anyone outside of Canada but you have to consider if this will be worth your time, effort and money. Are the damages suffered from the breach worth pursuing? What is your motivation in suing the ex-employee? Does this person have the assets to satisfy any judgement you may get against him? There are many other questions you may want to ask yourself before pursuing this. You may also want to consider suing the company he went to work for if you can demonstrate that this company induced him to breach the non-solicitation agreement.
