We have joint custody and primary residence of our 6 year old granddaughter. We have an agreement under the Family Relations Act of BC. Our agreement does not make any provisions for the returning of the child or for visitation. After 3 years with us they want her back. The parents had drug issues. They claim to be free of drugs now.

No, the test is "the best interest of the child". If there is evidence to show that it is in the child's best interest to remain with you then that is what a court will order.
