Bc hydro smart meter affecting my heath since installation, i want my old meter back!

BC Hydro has installed the new smart meter on my house. It is located on the outside wall of my house directly outside my bedroom and bed. <p>&nbsp;</p> <p>Since installation , I've been experiencing insomnia and tinnatus (ringing in my ears) while in my bedroom everynight. It is stating to affect my sleep patterns and overall wellbeing.</p> <p>&nbsp;</p> <p>I have yet to call BC Hydro to complain for fear of my complaint just falling on deaf ears but I want my old analogue meter back.&nbsp;</p> <p>My question is, if I were to call BC Hydro and explain to them the effects the smart meter is having on my health could they be legally obligated to return my old meter? If not, is it legal for me to do the exchange myself with a meter that I purchase myself?&nbsp;</p> <p>Obviously I would inform BC Hydro of my intended swap before hand and offer them a chance to do it themselves but with the service I've had from them in the past it is not looking good.</p> <p>&nbsp;</p> <p>Any input would be apprecialted.</p>

Yes, absolutely.   If you provide proof to B C Hydro that anything they have done on your property is causing any form of loss or damage, they are legally obligated to cease causing this damage, and to compensate you for all loss and damage.  The key is of course proof.  You should seek out medical diagnosis of your ailments, and assisatnce with expert evidence that there is a causal link between the meter, and its function, and your illness.  Just as soon as you have that, you will be all set.
BC Hydro has the same obligation as anyone who provides goods or services.  If it can be shown on a balance of probabilities that their products or activities cause loss or harm, the law of products liability will respond.  It is the same legal principle that responded to the ESWA heating panels, dangerous breast implants, Vioxx and other drugs, etc.  These were of course all mass plaintiff multi million dollar lawsuits, based on proof of harm.
It may be that BC Hydro has purchased and installed thousands of these meters without knowing of their danger, although I think a number of people have asked BC Hydro to review the risks.
