I have a martial arts school. In June 2011 a parent registered his son for a 6 month term from June to December 2011. They paid in full and received an email copy of the membership agreement. The agreement has a clause stating that "I/we agree to receive an email receipt of this agreement and check this box in lieu of signature." (He did not sign a copy of the agreement.) Their son did not attend many classes and as a result they are asking for a refund. Our policy is that a student has a 10 day cooling off period in which they can rescind their agreement in writing. This was not done, a refund was only requested for the first time in November 2011. What is my legal responsibility? Am I legally bound to issue a partial refund?Thank you.
