Hi there i recently bought my first car off of kjiji. the ad stated it had recently had a new motor put in. I brought a friend with me to look at it, test drive it and witness the cash exchange for the vehicle. there were no problems upon test driving the vehicle. I registered the vehicle and went to pick it up yesterday and there were no issues on the drive home. However, when i took it out today to have it certified and emissions tested a knock in the motor arose and the mechanic at the emissions place told me he wouldnt even be able to test it for safety reasons. he then told me the knock was from my main crankshaft and that i needed an entirely new motor. I want to call the guy who sold it to me and ask for most of if not all of my money back, im 18 and this was to be my first car. I worked long and hard to pay for it and its already insured in my name. im just wondering if its possible to get my money back or if theres any legal issues involved or if im up a certain creek without a paddle
many thanks,
-K
P.S. i wasnt quite sure what practice area this might fall under, I hope someone can help.

You would have been in a better position if you had a simple contract confirming what the seller said was the state of the car. Even better, it could have made the seller responsible for defects discovered in the first XX weeks or if the car could not be safetied. The main point of a contract is to make sure the parties get what they bargained for.
However, if the ad stated that the seller had recently put in a new motor, and didn't, then you likely have a good case to request your money back based on misrepresentation.
If the seller had put in a new motor and it simply failed, then the seller will not have done anything wrong and you are likely saddled with bad luck.
It wouldn't hurt to consult a local lawyer with full details.
