I was involved in what ICBC ruled as a 50-50 fault collision, I believe I was T-Boned and the damage as well as other information I compiled shows exactly that. I believe it would have been quite impossible for me to have caused our accident. I told ICBC that I didnt leave my lane that he must have left his and hit me. Of course because there were no eye witnesses the other driver also told ICBC that I left my lane and hit him. I wish to know if my case would hold in court or if I would be easily argued by the other driver and he would "Win Again"

This case, if taken to Court, comes down to credibility and any inferences that can be drawn from the physical evidence.
With two competing versions of events it will come down to who's version is beleived by the judge as well as which version is most compatable with the material damage.
