My husband recently helped his parents by paying out their mortgage. What legal document should we have in the event of their deaths or the sale of the property? We don't want to pay tax again as we used our already taxed money to help them. I am not sure what to call this help is it a gift or do what?

Sounds to me like an interest-free or interest accumulating loan and that you should register on title the loan documentation.
