I need to change a custody order that was made in 2002. It states that the father has interim access sat and Sunday's. We haven't seen or heard from him in now close to 10 years. My daughter is almost 11. I do not know where he is and how to find him. Family maintenance will not tell me anything. I've searched for him but nothing comes up. Is serving him the only option to change this court order? To boot I think he still has a warrant out for his arrest here in BC, so he won't come back.

Yes, you need to serve him with your application to vary any existing orders. However, if you cannot locate him you can make an application for substituted service in which case you will need to satisfy the court that you made reasonable efforts to locate him.
