Fit for duty policy, ontario government

A person works for the Provincial government in a safety sensitive position and a recent "Fit for duty " policy has been imposed. This policy states that employees must be Marijuana free for 28 days yet it is legal in the province. The 28 days seems extensive. Has there been any legal proceedings started against these policies yet from a medical or discriminatory stand point? Thank you
