Assault/battery

Hello. I am an Albertan and I have a question concerning a domestic assault charge that has been laid against my father. He has admitted to me that he did in fact smack my mother but that before that happened she used her vehicle to run over tractor parts on purpose and that he removed her from the vehicle in order to stop her and smacked her in frustration. He also stated to me that she attempted to hit him with the vehicle after she got back into it. My question is can he have her charged with attempting to assault him with a weapon and is a vehicle considered a weapon in this case?

Hi there, you may want to talk to the police officer and fill out a witness statement. You may also choose to meet with the officer who charged your dad and explain the circumstances. Last but not least, these arguments could be raised in court to your dad's defence. Hope this helps.
