Police contact

Hello, if someone (an employer) filed a report against someone for benefit fraud, how quickly would the police contact that individual? Someone I know admitted to benefit fraud 3 weeks ago, repaid the funds. The insurer said that they were not pursuing legal charges and the employer hadn’t informed them that they were pursuing criminal charges either. How long should this person worry about the police contacting them?

For most criminal charges, the police usually want to lay the charges as soon as possible after investigating a crime.  In a case like this, the investigation would be assisted by the insurer, who likely would have all the paperwork to hand over to police.

There are 3 types of criminal offences -  Summary Conviction, Indictable and Hybrid.

For Summary Conviction offences, there is a 6 month limitation period of the offence date for police to lay charges.  For Indictable offences, there is no limitation period.   A Hybrid offence is one that allows the Crown to choose how to proceed - either by Summary Conviction or Indictment.  Most criminal offences are Hybrid, allowing the Crown to proceed either way.
