Withholding payment for weekly overages.

Given the following clause in a contract work agreement:The Contractor shall work on an estimated 16 - 24 hours per week or as requested by the Company. All extended hours to be rendered by the Contractor shall be pre-approved by the company, in writing.Is it legal for an employer to not pay a contractor for work in excess of 24 hours in a single week that have not been pre-approved, given that the work averages out to under 24 hours per week over several weeks?
