Every case is different and must be assessed individually, including a detailed assessment of the offender and a detailed assessment of the offence related circumstances.  There is no minimum punishment for a Theft Under $5,000 for a 2nd offence.  Jail is not mandatory.  The risk of jail will increase with the severity of the offence.

If the value of the property in question exceeds $5,000, the police normally will lay a Theft Over $5,000 charge, although in some cases, may lay a multi-count Theft Under $5,000 information, in order to avoid a situation where the accused elects to have a trial in Superior Court (which is what they'd be entitled to on a Theft Over $5,000).
