Damaged items

Purchased an item Online and it arrived with damages, I paid shipping insurance on this order and no where on the site does jt have a warning about possible damages which should not matter anyways with shilling insuance. Now the seller has agreed to try an fix the item by sending another he said u must expect some damage along with “its going to get scratched an dented anyways”. I paid alot for this item i would expect it to come on a nice clean box not rips tears and no dents to my items whata should i do? He said if he sends another an its scratched wven with insurance then its my issue?
