Misleading & or false statements

Can a company official state in a company email to any party (Oct 2016) "in addition to the above (the persons name) has a history of personal issues which caused them to be off work on short term as well as long term disability for numerous occasions and length of time (then list the time periods)" with out stating that company officials were the cause of the personal issues? Date retired Dec 2014.
