Can I sue my real estate agent for negligence? When I sold my house, my girlfriend and I had to go in to his office and sign papers. We asked if there were any liens on the property and he said no, everything was good. We signed the papers and I was told the cheque would be ready for pick up the next day. I got a phone call from their office the next day saying a problem had come up, their was a lien on the property, it would be paid out of the house profits and it delayed my receiving the cheque for a few days. I am wondering if it was my lawyers responsibility to inform me before signing of any liens, because had I known I likely could have settled the debt for less.
